CONTINENTAL LIMITED MIXER REPLACEMENT PARTS WARRANTY Revised 11-09
Continental Mfg. Company, Inc. (“Continental”) warrants concrete mixer components manufactured by Continental to be free of defects in material and workmanship, for the respective periods stated, under normal, non-negligent use and conditioned on the customer following all Continental recommended service. This warranty covers only components which, upon examination by Continental, are found to be defective in material or workmanship and are returned to Continental’s factory at 9797 Galveston Rd., Houston, Texas 77034. Continental’s obligation under this warranty is limited to repairing or replacing, at Continental’s option, any such defective components. All transportation charges must be prepaid by the customer. Warranty claim components must be returned to Continental promptly after the warranty claim is filed. Repair or replacement under this warranty will be made by Continental without charge for such repair service or replacement part. Under no circumstances will Continental have further liability with respect to this warranty.
Warranty periods vary by component and are: Drum (one year, prorated); Electric and Electronic Components (90 days); Chutes and Hoppers (6 months); Rollers (30 days); All other parts made by Continental (30 days). Warranty claims must be made in writing to Continental within the respective warranty period.
Components and items purchased by Continental from other manufacturers shall be covered by such other manufacturer’s warranty, and Continental extends no warranty with respect to such components and items.
The Eaton hydrostatic pump and motor carries a limited warranty against defects in material and workmanship under normal, non-negligent use and service by Eaton Corporation for a period of 2 years from the date of delivery to Customer. Lubricants and filters must be changed after the first 100 hours of operation and thereafter at one year or 1,000 hour intervals, whichever comes first, with the oil specified and filter recommended by the manufacturer.
The ZT drum drive carries a limited warranty against defects in material and workmanship under normal, non-negligent use and service by ZT Sabinov for a period of 2 years from the date of delivery to Customer. The lubricants must be changed after the first 100 hours of operation and thereafter at one year or 1,000 hour intervals, whichever comes first, with the gear oil recommended by the manufacturer.
Continental’s warranty shall not apply to components that have been subject to misuse, negligence, or accident, or which has been repaired or altered without Continental’s prior knowledge and consent. Continental is not responsible for repairs made by personnel not approved by Continental.
THIS LIMITED WARRANTY IS VOID IF CONTINENTAL’S COMPONENTS ARE MODIFIED, UNLESS AUTHORIZED BY CONTINENTAL IN WRITING. THE USE OF PARTS AND ASSEMBLIES FROM OTHER MANUFACTURERS AS SUBSTITUTES FOR OEM PRODUCTS VOIDS THIS WARRANTY. THE WARRANTY ON USED OR RECONDITIONED PARTS ONLY THIRTY DAYS.
IN NO CASE SHALL CONTINENTAL BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL, SPECIAL OR INDIRECT DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LABOR COSTS, AND COMPONENT PAINTING.
Continental extends no other warranties, expressed or implied, including, without limitation, the warranties of fitness for a particular purpose and merchantability, all of which are hereby disclaimed.
Customer must keep applicable service records, to be supplied to Continental upon request. Lack of such records voids this warranty. The relevant warranty period begins on delivery of the component to Customer and runs for successive calendar days thereafter. Customer’s exclusive remedy for breach of this warranty is the fair market value of the component in question. The laws of Texas and of the United States apply to this warranty. All unresolved warranty claims shall be resolved exclusively by arbitration in Houston, Texas, under the commercial arbitration rules of the American Arbitration Association.
